Terms of Service

These Terms of Service are an agreement between you and Spark Jobs Platform Inc. ("Spark", "we", "us"). By creating an account or using Spark Jobs you agree to them and to our Privacy Policy. Employers also agree to our Employer Terms.

1. What Spark Jobs is

Spark Jobs is a job board that connects students with work at every level: part-time and seasonal jobs, internships, co-ops, entry-level and on-campus roles, and local gigs. It also lets employers, schools and community posters publish opportunities, and lets members talk in community groups. These terms cover the Spark Jobs mobile app (iOS and Android), the web app at sparkjobs.ca/app/, and this website; wherever they say "the app" they mean it on any device you sign in from.

2. Who can use Spark Jobs

• You must be at least 14 years old. We do not allow accounts for anyone younger, and we delete them when we find them.
• If you are 14 or 15, a parent or guardian must confirm your account by email before you can apply to jobs, message other users, claim gigs or post. Until then you can browse and build your resume.
• If you are under 18, employers can only find your resume once a parent's or guardian's consent is on file, and local gigs follow your region's legal working age.
• You must give your real date of birth. Once saved, only Spark support can correct it. Giving a false date of birth is a breach of these terms.
• Employer accounts must be run by an adult who is allowed to hire for that organization. Verified poster badges are for adults only.

3. Your account

You are responsible for your account and for everything posted from it. Keep your login private and your information accurate. You must be legally allowed to work, or to hire, in your region for the work you look for or offer.

4. Acceptable use, and zero tolerance

Spark has zero tolerance for objectionable content and abusive users. You must not post, send or share:

• harassment, bullying, threats, hate speech or content that demeans people for who they are;
• sexual content, and any content that sexualizes or endangers a minor (we remove it, ban the account and report it to the authorities);
• violent or graphic content, or content that promotes self-harm, drugs or illegal activity;
• fake, misleading, discriminatory or illegal job or gig posts, scams, or requests for payment from applicants;
• spam, other people's private information, or content you don't have the right to share.

You must not impersonate anyone, scrape the service, misuse our verification or school programs, or try to break or overload Spark. You can report any post, comment, listing, message or user, and block users, from inside the app. We review reports promptly and aim to act within 24 hours: we may remove content, limit features, and suspend or permanently ban accounts that break these rules, without notice where safety requires it.

5. Your content

You own the content you add to Spark (your profile, resumes, posts, photos, videos and messages). You give Spark a non-exclusive, worldwide, royalty-free licence to host, store, copy, display, adapt the format of, and process that content only to run, secure and improve Spark: for example to show it to the people you choose, to screen it for safety, and, if you allow it, to process it with Spark AI. The licence ends when you delete the content or your account, except for copies we must keep for legal reasons or that remain for a short time in backups. Do not add content you don't have the right to share.

6. Job content

Listings come from employers, school and job-board partners, community posters and public job feeds. We work to filter out bad posts but cannot guarantee every listing. Never pay to apply for a job, and apply with common sense; see our safety tips and fraud policy.

7. Local gigs

Spark Jobs is a venue that connects neighbours. It is not the employer of either side and not a party to the arrangement. Payment, taxes and insurance are between the poster and the helper, and both sides confirm a recorded legal check-off before posting or claiming.

8. Spark AI

• Spark AI features use OpenAI and Anthropic to process the information a feature needs, only after you give permission. You can withdraw it at any time in Settings. See the Privacy Policy.
• AI output can be wrong or incomplete. Review it before you use it. It is not legal, career or employment advice, and you are responsible for what you send to employers.
• Employers may use Spark AI to compare an applicant's resume with their job only if that applicant has allowed Spark AI. AI results are advice for a person to consider; they must never be the only basis for a hiring decision.

9. Payments and subscriptions

• Spark Pro, Employer Pro and Founders purchases are billed through the Apple App Store or Google Play. Prices are shown in the app before you buy.
• Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Manage or cancel in your App Store or Google Play account settings. Deleting the app or your account does not cancel a store subscription.
• Refunds are handled by Apple or Google under their policies.
• For purchases through the App Store, Apple's Licensed Application End User License Agreement also applies. If it conflicts with these terms, these terms apply to the extent the law allows.
• Paid tiers unlock app features; they never guarantee employment.

10. School and company partnerships

Schools, school boards, colleges, universities, co-op offices and companies can contract with Spark. Those contracts are billed directly between Spark and the organization, never through the app stores, and are never charged to students or to individual team members.

• School-provided Spark Pro covers only student accounts their school has verified, for example with a join code the school issued or the school's approval. Naming a school on your profile does not make you a member. It ends when your school membership ends (you leave, your school removes you, or it lapses on August 31 and you don't verify again), when the school's contract with Spark ends, or if your account is suspended or is no longer a student account. It does not cancel a subscription you already pay for through the App Store or Google Play.
• Do not join a school you do not attend, share a join code beyond the people your school gave it to, or otherwise obtain coverage you are not entitled to. We may remove coverage obtained that way and suspend accounts that do it.
• Company partner seats give the employer accounts a company names Employer Pro while its contract runs.

11. Ending things

You can delete your account at any time from Settings; deletion is permanent. We may suspend or close accounts that break these terms or put others at risk. Sections 5 (for content already shared), 12, 13 and 15 continue after your account ends.

12. Disclaimers and limits of liability

Spark Jobs is provided "as is" and "as available". We do not guarantee that any listing is accurate, that you will get a job, or that the service will always be available or error-free. We are not a party to any employment or gig arrangement made through the app. To the fullest extent the law allows, Spark is not liable for indirect, incidental, special or consequential losses, or for lost profits, wages or data, and our total liability for any claim relating to Spark is limited to the greater of the amount you paid Spark in the 12 months before the claim and CAD $100. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

13. Apple

If you use the iOS app: these terms are between you and Spark, not Apple, and Spark (not Apple) is responsible for the app and its content, maintenance, support, and any claims about it (including product liability, legal or regulatory compliance, and intellectual property claims). Apple has no obligation to provide maintenance or support. If the app fails to meet any warranty that applies, you may notify Apple, which may refund the purchase price, and Apple has no other warranty obligation. You confirm you are not in a country under a U.S. government embargo or on a U.S. government restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

14. Changes

If we change these terms materially, we update the version and date at the top and ask you to read and accept the new version in the app before you continue.

15. Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
